Welcome to KashiFab (https://kashifab.com). These Terms & Conditions (“Terms”) govern your access to and use of the Website and any purchase of fabrics, sarees, finished ethnic products, or related services from KashiFab.
By browsing the Website, registering an account, placing an order, or submitting a wholesale/export enquiry, you agree to these Terms. If you do not agree, please do not use the Website.
These Terms form an electronic contract under the Information Technology Act, 2000 and do not require a physical signature. Please also read our Privacy Policy and Shipping & Returns policy, which form part of your agreement with us where applicable.
1. Definitions
- “Website” means https://kashifab.com and related pages, apps, or checkout flows operated by KashiFab.
- “Customer” / “you” means any retail shopper, designer, boutique, wholesaler, exporter, or visitor using the Website.
- “Products” means Banarasi / Varanasi silk fabrics (including meterage / thaan), sarees, finished goods, samples, and any other items offered on the Website.
- “Order” means a confirmed purchase request placed through the Website or accepted by us in writing/email for wholesale or export.
2. Eligibility
You confirm that you are at least 18 years old and legally capable of entering into a binding contract under Indian law. If you order on behalf of a business, you confirm you are authorised to bind that business to these Terms.
3. Products, descriptions & handloom variations
KashiFab specialises in Banaras / Varanasi silk and related textiles. Because many products are handloom or hand-finished:
- Colours on screens may differ slightly from actual fabric due to lighting, device calibration, and natural dye/yarn variation
- Minor weave irregularities, motif alignment differences, or shade variation across lots can occur and are characteristic of authentic handloom goods, not automatic defects
- Product images, weights, and motif descriptions are provided in good faith; technical specs may be updated when yarn or loom batches change
- Stock availability is not guaranteed until an Order is confirmed and payment (or approved wholesale terms) is received
If you need an exact shade match for a production run, request a swatch / cutting approval before bulk confirmation.
4. Pricing, taxes & offers
- Prices are listed in Indian Rupees (INR) unless otherwise stated
- Applicable GST and other taxes will be shown at checkout or on quotation/invoice
- We may correct pricing errors and will contact you before proceeding if an obvious error affects your Order
- Promotional codes, festive offers, and wholesale discounts are subject to stated conditions and may be withdrawn or adjusted
- Wholesale / export pricing, MOQs, and lead times are confirmed on quotation and may differ from retail website prices
5. Orders, acceptance & cancellation
An Order is an offer to buy. We may accept or decline an Order (for example due to stock, suspected fraud, incomplete shipping details, or export restrictions). A contract is formed when we confirm acceptance and/or dispatch.
- Retail cancellation: You may request cancellation before the Order is packed/shipped by contacting us promptly. Once shipped, our Shipping & Returns policy applies.
- Custom / made-to-order / cut fabric: Once cutting, weaving, dyeing, or custom production has started, cancellation is generally not available.
- Wholesale / export: Cancellation, revision, and deposit terms follow the accepted quotation / proforma invoice.
- For prepaid Orders cancelled before dispatch, refunds are returned to the original payment method within a reasonable banking/gateway timeline.
6. Payment
We accept payment methods displayed at checkout (and bank transfer / approved terms for wholesale). You authorise us and our payment partners to charge the payable amount. Orders may be held until payment clears. Suspected fraudulent transactions may be cancelled and reported as required.
7. Shipping & delivery
Delivery timelines are estimates. Domestic and international transit times vary by destination, courier, customs, and production schedules. Risk typically passes as described in our Shipping & Returns policy and/or courier terms. You must provide accurate shipping details; failed deliveries due to incorrect details may incur re-shipping charges.
International buyers are responsible for customs duties, taxes, and import compliance in the destination country unless otherwise agreed in writing.
8. Returns, exchanges & fabric-specific conditions
Returns and exchanges are governed primarily by our Shipping & Returns policy. In addition, for fabric ecommerce (consistent with common industry practice):
- Requests for damaged, defective, or incorrect items should be raised promptly with Order number and clear photos
- Returned Products should be unused, unwashed, unstitched, with tags/packaging intact where applicable
- Cut lengths, custom-dyed, custom-woven, clearance, or specially procured lots may be non-returnable unless defective
- Screen-to-fabric colour difference alone is not automatically treated as a defect
- Approved refunds are processed to the original payment method or as otherwise agreed for wholesale accounts
9. Wholesale, B2B & export
For bulk fabric programs, samples, and export orders:
- Quotations are valid for the period stated (or a reasonable short period if unspecified)
- MOQs, lead times, packing, and documentation requirements must be agreed before production
- Approved samples / swatches become the quality reference for the bulk lot, subject to normal commercial tolerances
- Export documentation is coordinated in good faith; buyer remains responsible for destination import compliance
10. Account responsibility
If you create an account, you are responsible for safeguarding login credentials and for all activity under your account. Notify us immediately of suspected unauthorised use. We may suspend accounts to protect security or prevent misuse.
11. Intellectual property
All Website content — including logos, product images, text, graphics, and catalogue arrangements — is owned by or licensed to KashiFab. You may not copy, scrape, republish, or commercially reuse Website content without prior written permission. Product designs and traditional weave motifs remain subject to applicable IP and cultural heritage considerations; purchase of fabric does not transfer design copyright unless expressly agreed.
12. Acceptable use
You agree not to:
- Use the Website for unlawful, fraudulent, or abusive purposes
- Attempt to gain unauthorised access to systems, data, or other users’ accounts
- Interfere with Website security, introduce malware, or overload infrastructure
- Harvest product data or personal data through bots without permission
- Post defamatory, obscene, or infringing content in reviews or forms
13. Product advice disclaimer
Guides, blog articles, and staff suggestions about fabric choice, GSM, or garment use are general information only and not a substitute for professional tailor/designer judgment. You are responsible for verifying suitability (including shrinkage, care, and end-use) before cutting or production.
14. Limitation of liability
To the maximum extent permitted by Indian law:
- KashiFab is not liable for indirect, incidental, special, or consequential damages (including lost profits or business interruption) arising from Website use or Product purchases
- Our total liability for any claim relating to an Order is limited to the amount you paid for the Product(s) giving rise to the claim
- Nothing in these Terms excludes liability that cannot be excluded under applicable law (including certain consumer protections, where they apply)
15. Indemnity
You agree to indemnify and hold harmless KashiFab and its officers, employees, and agents from claims, losses, and expenses arising from your misuse of the Website, breach of these Terms, or violation of law or third-party rights.
16. Force majeure
We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, strikes, transport disruption, epidemics, war, governmental actions, raw-material shortages, or loom/power interruptions affecting handloom supply.
17. Changes to Terms
We may update these Terms periodically by posting a revised version on this page with an updated date. Continued use of the Website after changes constitutes acceptance of the revised Terms, to the extent permitted by law.
18. Governing law & dispute resolution
These Terms are governed by the laws of India. Subject to applicable consumer protections, courts at Varanasi, Uttar Pradesh shall have exclusive jurisdiction over disputes arising out of or relating to the Website or these Terms.
